Do I get to claim my children on my tax return?
Hello, I have 2 children, My divorce just finallized november 18th 2009. I have been taking care of the children solely without child support since June of this year. The judge ordered back child support as well for the months he did not pay. When I looked at the child support orders which were ordered April 2009 it says he gets to claim them in 2009 but nothing else. It also says that he can only claim them if he has paid his child support in full. He did not pay for 1 and a half months and it has built intrest, it is now at 1,200 dollars. I was not working in April so I am guessing the judge just allowed him to claim them. I statred working in May and I want to claim my children. I am the cusodial parent and I know about the new form non-custodial parents must get the custodial parent to sign to claim the children but I don't think that applies if a judge already ordered him to claim them. Do I get to claim them because he is late on child support?
